Three High Court judges rejected a legal challenge this morning - despite acknowledging the policy's discriminatory impact on vulnerable groups

Nana Akua has launched a scathing attack on Labour's VAT policy on private school fees, calling it "completely disgraceful" following the High Court's dismissal of a legal challenge.

She condemned the policy as "an ideological attack on anyone trying to do well in life and provide the best opportunities for their children."


The comments come after three High Court judges rejected the legal challenge this morning, despite acknowledging the policy's discriminatory impact on vulnerable groups.

The court heard that the 20 per cent VAT on fees disproportionately affects lower-income families, particularly those with children with special educational needs and disabilities caught in council funding backlogs, and families seeking faith-based education.

Dame Victoria Sharp, Lord Justice Newey and Mr Justice Chamberlain found that the policy was "made by Parliament, in primary legislation, after full debate and was a manifesto commitment."

Speaking about this on GB News, Nana fumed: "The families involved have lost their appeal which I think is just shocking. The Government is pressing ahead with this policy, and I find that completely disgraceful.

"Now, as more evidence comes out, it's becoming clear that this is exactly what many of us said it was all along: an ideological attack on anyone trying to do well in life and provide the best opportunities for their children.

"We saw Keir Starmer initially claim that the money from this VAT raid would go toward hiring 6,500 teachers.

"But just last week, Bridget Phillipson admitted there won’t actually be 6,500 teachers what a surprise.

"Then yesterday, Starmer or whoever runs his social media tweeted that the money would now go toward affordable homes. Everything this Government says is just a smokescreen for a Marxist ideology that underpins all of their decisions.

"There’s more evidence now showing that 13,000 pupils have already left private schools and moved into the state system. That’s going to cost the Government more than they supposedly plan to spend on these affordable homes.

"The other weekend, I spoke to Labour peer Lord George Foulkes. He seemed to think and he said this out loud, so I’m not making anything up that people who send their children to private schools are really rich and have plenty of money.

"He was quite annoyed when I disagreed and told him he was completely wrong. The majority of private school parents are actually middle class. The truly wealthy will be unaffected by this policy.

"Also, just to correct a common misconception: private schools do pay VAT. It’s the school fees that didn’t previously have VAT applied. That’s what has changed.

"A lot of people assume private schools were exempt from VAT entirely, but that’s not true they’ve now added VAT to the fees.

"When I sent my son to private school in my late twenties, I lived on apples and yoghurts for a year just to afford it."

Julie Robinson, chief executive of the Independent Schools Council, said the organisation was "carefully considering the court's judgment and next steps" following the ruling.
