The police inquiry into Andrew Mountbatten-Windsor could widen beyond the offence of misconduct in public office, it has been reported.
Mr Mountbatten-Windsor could be investigated over other potential offences, police sources have told the Times.
The former Duke of York was arrested on his 66th birthday and released on investigation that evening.
Mr Mountbatten-Windsor's arrest related to his time as a Government trade envoy, when he allegedly passed confidential information to Jeffrey Epstein.
However, detectives at Thames Valley police are reported to be widening their investigation beyond the single offence.
Mr Mountbatten-Windsor has consistently denied any wrongdoing.
A police source told the Times: “The legal bar for Mipo is high. There was always an issue over whether he was actually a public official at the time, whether he actually signed any papers.
“It’s not surprising that they are having to look at broader offences.”

GB News has contacted Mr Mountbatten-Windsor for comment.
Lord Mandelson is also being investigated by the Metropolitan Police over the same offence of misconduct in public office, over alleged leaks to Epstein while he was in Tony Blair’s Government.
In a statement, Lord Mandelson said: "I was never culpable or complicit in his crimes. Like everyone else I learned the actual truth about him after his death.
"But his victims did know what he was doing, their voices were not heard and I am sorry I was amongst those who believed him over them."

Andrew was arrested last month on suspicion of misconduct in public office | REUTERSElsewhere, he said: "Yesterday, I did not want to be held responsible for his [Jeffrey Epstein's] crimes of which I was ignorant, not indifferent, because of the lies he told me and so many others.
"I was wrong to believe him following his conviction and to continue my association with him afterwards. I apologise unequivocally for doing so to the women and girls who suffered."
Sir Mark Rowley, the Met commissioner, has visited Washington to try to press the US authorities to expedite the release of unredacted exchanges in the files.
Mr Mountbatten-Windsor was stripped of his Duke of York title towards the end of last year and ordered to relocate to the Sandringham estate.

Mr Mountbatten-Windsor is currently living at Wood Farm while his permanent residence, Marsh Farm, undergoes renovations.
King Charles will be personally financing his younger brother's living expenses.
Meanwhile, Ms Ferguson is expected to finalise her own living arrangements.
