Fayaz Khan gave UK authorities a false name and date of birth

A small boat migrant who threatened to kill Reform UK leader Nigel Farage has been jailed for five years.

Fayaz Khan made the threat between October 12 and 15 last year in a TikTok video.

Sentencing judge at Southwark Crown Court Mrs Justice Steyn told Fayaz Khan she agreed with Mr Farage that his threats to kill the politician were "pretty chilling."

After the sentence was read out, Khan shouted from the dock that Mr Farage wanted to "use me because you want to be Prime Minister."

As he was taken down to the cells after the hearing concluded, Khan shouted: "You want to be Prime Minister, I am not here because I want to kill you.

"I want to go back to Afghanistan, send me back to Afghanistan, my family is in Afghanistan.

"You want to use me because you want to be Prime Minister.

"Just because you want to do that you want to f*** my life, you want to put me in prison."

Prosecutor Peter Ratliff told the court Swedish authorities believe his real name is Fayaz Husseini.

He claimed he gave a different name because he has "enemies he did not want to find him."

Mr Ratliff said prosecutors believe it is "more likely he has given a false name because of his record in Sweden."

The court heard Khan was one of 65 migrants onboard a black rigid inflatable boat that had entered UK waters crossing the Channel.

"The defendant livestreamed the recording of his crossing which appears to have gathered a large online viewing," Mr Ratliff said.

Mr Ratliff said records suggest Khan had been convicted of 17 offences on 12 separate occasions.

The prosecution said there were multiple low level offences, including some involving drugs.

The prosecutor told the court Khan was convicted in June 2019 of using threatening behaviour towards a public servant, for which he was imprisoned.

He was also convicted of carrying a knife in a public place in April 2020 and was jailed for three months in October of the same year for using threatening behaviour.

Khan was also convicted of vandalism which resulted in a two-month prison sentence in March 2023.

Fayaz Khan asked his lawyer to apologise to Nigel Farage for making a threat to kill him and for saying he was coming to England to marry his sister.

His lawyer Charles Royle told Southwark Crown Court: "I have instructions from Mr Khan to apologise to Mr Farage and to his sister for any offence and upset caused."

Mr Farage was sitting just metres away from the defendant in the court room.

Khan appeared to glance at him when he entered the dock but then spent the rest if the hearing to look straight ahead.

Speaking to reporters outside the London court building, Mr Farage said "Well, I suppose we call that a win.

"It was about the maximum sentence that could possibly be given, five years, given the scale of the offence.

"And I thank Justice Steyn. I thank the judge for saying what she said.

"But the fact is that in 18 months time this violent criminal, somebody with 17 convictions in Sweden, in 18 months time he will be in this country, living in a house of multiple occupancy or a hotel, free to walk the streets whilst his asylum claim is judged."
