An immigration judge has ruled that a Sudanese illegal migrant is a child - despite his beard and wrinkles.

After breaking into Britain via a small boat last February, officials initially assessed he was between 23 and 25 years old.


Officials from Liverpool City Council noted that the Sudanese national, known only as ASB, had sunken eyes, acne scars, a weathered face and a self-assured manner.

A second evaluation assessed he “did not present as a teenager" would typically do when facing a high-pressure situation, citing his lack of "fidgeting" and ability to "maintain eye contact".

He allegedly began shouting at the interpreter during the assessment after the pair become embroiled in a row.

Despite the initial two age evaluations raising doubts he was a minor, he was given the right to challenge the officials' decision.

After landing in Dover from France, the Sudanese migrant attempted to use his Facebook account as evidence of his age, which claimed he was born in 2008.

During a hearing at the Immigration and Asylum Chamber, the migrant's cousin was present to back up his claim, claiming the pair had spent holidays together in their grandmother's home.

His appeal was successful, with Upper Tribunal Judge Paul Lodato labelling the evidence presented before the hearing as “compelling”.

He said: "I am satisfied on the balance of probabilities ASB is the age he claims to be and is a child.”

However, such a ruling does not come without precedent.

In an almost identical case in May 2025, a Sudanese asylum seeker with hairy legs and arms and a deep voice was judged to be a child, overturning assessments by the Home Office and a council that he was in his mid-20s.

The court backed his claim that he was 16 years old, dismissing the Home Office's assertion that his physical appearance "very strongly suggested" he was "significantly over 18" and likely around 24.

The asylum seeker arrived in the UK in December 2023, telling officials he was 16.

But Upper Tribunal Judge Gemma Loughran dismissed the physical characteristics as "not a useful indicator of age".

It comes after GB News revealed thousands of illegal migrants were lying about their age to gain asylum in Britain - with Sudan the worst offender.

In 2024, a Freedom of Information request by GB News revealed a pattern in asylum application data between 2019 and mid-2024 which was identified by analysts as a "really significant statistical spike, which just does not look natural".

It showed a massive and unusual surge in migrants claiming they were 16 or 17 - raising fears that older migrants were claiming to be under-18s to gain asylum more easily in the UK.

Asylum applications filed by nationals from a handful of east African countries showed the trend at its worst.

In Eritrea, 1,830 out of 14,052 men, and 522 out of 4,962 women said they were aged between 16 and 17.

In Ethiopia, that number was 351 out of 2,384 men, and 68 out of 993 women.

In Somalia, it was 293 out of 2,082 men, and 100 out of 1,042 women.

And in Sudan, it was 3,095 out of 13,571 men.
