The 47-year-old is on trial for allegedly raping a 19-year-old woman in his car near gay nightclub Heaven

A Nigerian nightclub security guard accused of rape had no legal right to work in Britain, a court has heard.

Morenikeji Adewole, 47, is on trial at Southwark Crown Court for allegedly raping a 19-year-old woman in his car near gay nightclub Heaven in central London last November.

The defendant had been employed at Heaven under the false name Olusola Julius Alabi, using fraudulent identification documents to secure the position.

Jurors were told Adewole was on a five-year tourist visa that did not permit him to work in Britain and could not stay for more than six months at a time.

The defendant has pleaded guilty to two counts of possession of an identification document with improper intention.

Adewole gave a fake name to police when he was arrested following the alleged rape, with officers discovering his real identity through fingerprint evidence.

The court heard he returned to Nigeria when his permitted six-month stays expired.

While giving evidence, the defendant admitted to using a false ID in order to secure employment, explaining that he did so "to make a living... to save for my partner – I was the one who paid the rent."

He told the jury that he initially came to the UK on holiday and later decided to stay to find work.

When questioned about why he gave a false name to police upon his arrest, Adewole explained, "I was panicking – that’s the name people at work know me by."

LATEST DEVELOPMENTS:

He also told the court that he had first encountered the alleged victim several months prior to the incident, recalling that she had greeted him at the club.

The defendant said that "almost every night" at work he has "interactions" that can include people trying to kiss him.

On the evening of the alleged rape, he told her to stop and she later asked him for water.

"I told her I can't go inside the club to get her water, but I have water in my car," he added.

Adewole stated that during a break from work, he walked with the woman and her friend to his nearby Lexus, where he gave the friend a bottle of water, which the complainant also drank.

He said the teenager then asked him to accompany her to a nearby tunnel to use the toilet, explaining that it was a "dodgy area" known for "phone-snatchers and bag-snatchers."

CCTV footage captured the defendant and the complainant in the tunnel, where Adewole claimed they shared a kiss.

Adewole alleged that the teenager told him she "wanted sex from him," but he said he told her it couldn’t happen in the tunnel.

He claimed he then returned to collect his car and drove her to nearby Adelphi Terrace, where it is alleged she was raped in the back seat of the parked vehicle.

According to Adewole, there was sexual contact between them, but he denied having penetrative sex.

He also said the woman had initially told him she was 25-years-old, but later, in the car, stated she was 19, at which point he said he "stopped immediately."

When asked why, he responded: "I can't date someone below 25."

The court had earlier heard that the alleged victim was a Christian who intended to remain abstinent until marriage and had been intoxicated and stumbling that night and that a person can be too intoxicated to give proper consent.
