The defendant said that she did not know the recordings were illegal and therefore infringing copyright

Eric Clapton has won a case against a woman in Germany selling a bootlegged CD of a 1980s concert.

A Dusseldorf court ruled in favour of the rockstar who issued an injunction after seeing the recording for sale on Ebay for €9.95, the woman will now have to cover legal fees.

The defendant said that she did not know the recordings were illegal and therefore infringing copyright, explaining that her late-husband had gifted her the CD after purchasing it ‘at a well-known department store’.

Her appeal was rejected and the judge ruled against her, saying neither of these factors mattered.

She has also been told if she continues the sale she will face a fine of €250,000 or six months in prison.

Clapton has been the centre of controversy since the pandemic began, after speaking out against lockdowns and refusing to play venues that required proof of vaccination.

He also featured on "anti-vaxxer" Van Morrison on his song "Stand and Deliver”.

The song features the lyrics: "Do you wanna be a free man…Or do you wanna be a slave?"
