The Court of Appeal has overturned the removal of 138 asylum seekers housed at the Bell Hotel in Epping

An Epping Councillor has demanded that The Bell Hotel be "emptied" of the 138 migrants staying there, despite the Court of Appeal's ruling.

Speaking to GB News, Reform UK councillor Jaymey McIvor said he is "devastated" by the verdict on the hotel, highlighting the concerns for the "safety of women and children" in Epping.


Delivering the verdict, Lord Justice Bean, sitting with Lady Justice Nicola Davies and Lord Justice Cobb, warned that the previous ruling was "seriously flawed in principle".

He added: "The judge's approach ignores the obvious consequence that the closure of one site means capacity needs to be identified elsewhere in the system."

Reacting to the overturning of the hotel's closure, Mr McIvor told GB News National Reporter Jack Carson: "I'm absolutely delighted that the people of Epping have not given up on their peaceful protesting, but obviously I am devastated.

"I am gutted for those women, particularly those local mums and those local schoolgirls who yesterday were talking to me outside the hotel, emotionally."

He added: "They really thought that next week, when the children go back to school, that this hotel would be closed and that the people in the hotel would be moved.

"And instead, what we now have is parents talking about having a rota along the pavement, who can supervise young girls going to school. In what sort of country does that have to happen?"

Hitting out at the Home Office's decision to appeal the hotel's closure, Mr McIvor issued a stark warning to the Government: "This is a seriously bad situation and I would urge the Home Office, despite the ruling, to empty this hotel immediately.

"It is next to a school. What does this Government not understand when it comes to the safety of women and girls?"

Backing Reform UK leader Nigel's Farage's call for Britain to leave the ECHR, the Epping councillor stated: "It's not right that the European Court of Human Rights is being put against the people of Epping, and that's why we need to leave the ECHR as soon as possible.

"This is Britain. We should only be dictated by our laws that our Parliament, our so-called sovereign parliament has legislated. We should not have the use of foreign courts and foreign statute to even come near decisions that affect such local issues."

Mr McIvor told GB News that Britain needs to 'leave the ECHR'

Highlighting the legacy of Sir Winston Churchill, Mr McIvor concluded: "One thing that we should recognise is Sir Winston Churchill, the former Member of Parliament for Epping, was instrumental in the European Convention of Human Rights.

"And obviously it had very noble reasons to be founded when it was. But I bet you, Sir Winston Churchill did not ever dream of a day that that convention would be used against his own constituents, particularly the safety of women and girls here in his own constituency."

More than 12 councils are set to take legal action against the Government regarding the housing of asylum seekers in hotels, despite the Home Office's recent court victory.

The councils include at least four Labour-run authorities, including Wirral, Stevenage, Tamworth and Rushmoor.
