Dog owner spared jail after 'unpredictable' Rottweiler mauled two people in separate attacks

The court heard that jogger Holly-Jean Emery was out running with her Jack Russell when the Rottweiler - named TJ - ran towards her and locked its jaws on her elbow before dragging her to her knees.

Emery asked Probert for help and after freeing her arm, which was bleeding heavily, went to hospital for her injuries.

Prosecutor Dean Pulling said the jogger suffered puncture wounds to her arm and a partial tear or rupture to her muscles.

Part of the dog's tooth was also found embedded in her wound.

After the incident was reported to police, officers searched the scene but could not locate Probert.

A year after the attack, Emery spotted the owner again and informed the police.

Almost one year after the attack on Emery, TJ attacked a grandfather while he unloaded a van on August 23, 2023.

The dog ran towards the second victim, Mark Bennett, and jumped up which left him hospitalised with bite wounds.

Probert was later arrested and police seized his dog, which he said he had owned for three years after buying it from a breeder.

He pleaded guilty to two counts of being the owner of a dog which was dangerously out of control and caused injury.

Giles Hayes, defending Probert, said the dog lived in a house around young children and there had never been any issues.

Judge Huw Rees said although the dog could be "docile" when with his family it was "unpredictable" and issued a destruction order.

Probert was also handed a 14-month suspended sentence and ordered to carry out 180 hours of unpaid work.
